Big Kahuna Contracting Referral Program

     1. Program Overview

The Big Kahuna Contracting Referral Program rewards eligible individuals who refer new customers to Big Kahuna Contracting for qualifying projects. Participation in the program is subject to these Terms and Conditions.

     2. Eligible Referrals

To qualify:

• The referred customer must be a new Big Kahuna Contracting customer and must not already be discussing the same project with Big Kahuna Contracting.

• The referred customer must identify the referrer when first contacting Big Kahuna Contracting or when submitting the Referral Project Inquiry Form.

• The referral must be recorded before a quote, estimate or contract is issued for the referred project.

• The referred customer must enter into a contract with Big Kahuna Contracting for a qualifying project.

• The project must be completed, and all amounts owing to Big Kahuna Contracting must be paid in full.

Submitting a referral or inquiry form does not automatically qualify the referrer for a reward.

     3. Referral Rewards

Referral rewards are based on the final qualifying project value before HST:

• $2,500–$9,999: $100 reward
• $10,000–$24,999: $250 reward
• $25,000 or more: $500 reward

Only work completed directly by Big Kahuna Contracting will be included when calculating the qualifying project value.

HST, permits, engineering fees, delivery charges, financing charges, third-party products or services and other costs not directly attributable to work completed by Big Kahuna Contracting are excluded.

Big Kahuna Contracting may exclude subcontractor or third-party costs when calculating the qualifying project value.

     4. Payment of Rewards

A referral reward becomes payable only after:

• The referred project has been completed;

• Big Kahuna Contracting has received payment in full for the project; and

• The referral has been reviewed and confirmed as eligible.

Eligible rewards will be issued within 30 days after the referred project has been paid in full.

Rewards may be paid by cash, cheque or e-transfer. The payment method will be determined by Big Kahuna Contracting. Referrers receiving a cash reward may be required to sign a receipt confirming payment.

The referrer is responsible for any personal tax obligations associated with receiving a referral reward.

     5.Referral Identification

The referred customer is responsible for identifying the referrer when first contacting Big Kahuna Contracting.

Referrals cannot be added retroactively after a quote, estimate or contract has been issued.

Big Kahuna Contracting may contact the referrer or referred customer to verify the referral information.

     6. Multiple Referrers and Duplicate Claims

Only one referral reward will be issued for each referred customer, household, project or project address.

If more than one person claims the same referral, the reward will be assigned to the first eligible referrer identified in Big Kahuna Contracting’s records and confirmed by the referred customer.

A referred customer cannot change the identified referrer after the referral has been recorded unless Big Kahuna Contracting determines that a genuine error occurred.

     7. Ineligible Referrals

The following are not eligible:

• Self-referrals;
• Referrals between members of the same household;
• Referrals involving the same residential or mailing address;
• Customers or projects already known to, quoted by or in discussion with Big Kahuna Contracting;
• Referrals submitted after a quote, estimate or contract has been issued;
• Duplicate referral claims;
• Projects that are cancelled, unpaid, refunded or not completed;

• Projects valued below $2,500 before HST and excluded costs;
• Referrals containing false, incomplete or misleading information;
• Referrals created using aliases, duplicate identities or fictitious individuals;
• Referrals involving coordinated submissions intended to obtain a reward improperly;
• Employees, owners, subcontractors or immediate family members of Big Kahuna Contracting, unless approved in writing;
• Professional lead generators, marketing companies or individuals referring customers as part of a paid lead-generation service; and
• Referrers with an overdue or outstanding balance owing to Big Kahuna Contracting.

     8. Project Splitting and Manipulation

Projects may not be divided, combined, transferred or structured for the purpose of qualifying for a reward or increasing the reward amount.

Related work completed for the same customer, household or project address may be treated as one project or as separate projects at Big Kahuna Contracting’s discretion, based on the contracts, scope of work and timing involved.

Change orders and additional work will only be included in the qualifying project value if they are completed and paid in full.

     9. Fraud, Misrepresentation and Reward Recovery

Big Kahuna Contracting may reject, suspend or investigate any referral that appears fraudulent, misleading, manipulated or inconsistent with the purpose of the Referral Program.

Big Kahuna Contracting may withhold or cancel a reward if:

• Referral information cannot be verified;
• The referrer or referred customer provides false or misleading information;
• The parties attempt to manipulate the program;
• Payment for the referred project is reversed, disputed or refunded; or
• The referral otherwise violates these Terms and Conditions.

If a reward has already been issued in connection with fraud, misrepresentation, a payment reversal or an ineligible referral, Big Kahuna Contracting may require the reward to be repaid.

     10. No Guarantee of Work or Reward

Big Kahuna Contracting is not required to accept, quote or complete any referred project.

A referral does not guarantee that the referred customer will receive a quote, enter into a contract or proceed with a project.

A reward is not guaranteed until Big Kahuna Contracting confirms that all eligibility requirements have been met.

     11. No Combining or Transfer of Rewards

Referral rewards cannot be transferred, assigned, sold or combined with another person’s reward.

Unless approved in writing by Big Kahuna Contracting, a referral reward cannot be combined with another referral promotion, discount, credit or incentive for the same customer or project.

     12. Changes or Cancellation

Big Kahuna Contracting may change, suspend or end the Referral Program at any time.

Referrals properly submitted before a change or cancellation will be assessed under the terms in effect when the referral was received, unless otherwise required by law.

     13. Privacy

Personal information collected through the Referral Program will be used to respond to project inquiries, verify referrals, administer rewards and maintain business records.

Participants must only provide accurate information they are authorized to share.

Personal information will be handled in accordance with Big Kahuna Contracting’s privacy practices and applicable Canadian privacy laws.

     14. Program Administration

Big Kahuna Contracting may review referral claims, request additional information and determine eligibility based on these Terms and Conditions and its business records.

Big Kahuna Contracting’s records regarding the date of first contact, referral identification, project value, project completion and payment status will be used to administer the program.

Decisions regarding eligibility, qualifying project value and reward amounts will be final, subject to applicable law.
